Terms and Conditions
1 – GENERAL: These Terms and Conditions set out how you (the sender) may use HandwrittenHateMail.com (sometimes referred to as HHM) and also your relationship with HandwrittenHateMail.com.
2 - PURPOSE OF THE SITE:
2.1 - HandwrittenHateMail.com provides a creative document-production and mailing service for individuals. By completing your message for transcription you acknowledge and agree that access to, and use of, HHM’s service is subject to these terms and conditions of service as well as the regulations set forth by the United States Postal Service. You acknowledge that your message will not be transcribed exactly as you enter it, and that it will be up to the interpretation and creative vision of the writers at HHM to craft the letter to your recipient.
2.2 - HandwrittenHateMail.com is established in the United States, and mails letters internationally. By accessing this site you agree to submit to the exclusive jurisdiction of the Supreme Court of the State of New Jersey in relation to any claim or dispute arising out of or connected with your use of the site.
2.4 - Users of this site are reminded that its contents and constituent parts are protected by copyright, trademark and other laws. HandwrittenHateMail.com may allow links to and from other sites but such linkage does not imply endorsement, sponsorship or recommendation of such sites or the products or services offered by them. Accessing such sites is done at the user’s own risk and HandwrittenHateMail.com is not responsible for the content, or the use of, any such sites.
3 - SUPPLY AND USE OF HANDWRITTENHATEMAIL.COM SERVICES
3.1 - This site and HandwrittenHateMail.com’s service may be used only for lawful purposes.
3.2 - As a user you are responsible for maintaining the confidentiality of your communications and other information.
3.3 - HandwrittenHateMail.com will use all reasonable efforts to provide its transcription service in a proper professional manner and within the time limit agreed with you for that purpose but excludes any liability for any failure or delay in providing its service where same is caused by a reason beyond the control of HandwrittenHateMail.com including, but not limited to:
- Force Majeure;
- Breaks in continuity of electricity supply or telecommunications link;
- Failure of, or unavailability of or any technical problems affecting, the United States Postal Service or any termination of your or HandwrittenHateMail.com’s rights to utilize the USPS where this arises from any misconduct or misuse or breach by you of the USPS’s postal regulations;
- Any other reason beyond HHM’s control.
4 - PAYMENT FOR SERVICES
4.1 - You agree to pay HandwrittenHateMail.com’s charges at the standard rate applicable from time to time as set out in the payment section, or at such other rate as may be separately discussed and agreed between you and HandwrittenHateMail.com and notified to you. Payment is due immediately before commencement of the work and you agree to pay (in full without deduction) all charges associated with the level of service you choose. In the event of a dispute, you agree to settle such dispute with the Supreme Court of the State of New Jersey, and not to file a dispute with a third party or payment processor, specifically but not limited to PayPal, Visa, Mastercard, American Express, or Discover.
4.2 - In the event that payment is withdrawn or returned after work has commenced then, in addition to its right to claim for payment, HandwrittenHateMail.com reserves the right to discontinue, withhold or suspend performance of other existing, or new/additional, work for you until such time as payment in full is made.
4.3 - Under any circumstances, no refund shall be payable once HandwrittenHateMail.com has commenced its transcription - except where HandwrittenHateMail.com in its sole discretion decides to make such a refund.
5 - YOUR ANONYMITY: HandwrittenHateMail.com agrees to keep you (the sender) and your identity private from the recipient of the letter, unless:
- The identity of the sender has been requested by law enforcement.
- The sender has breached local or federal laws by utilizing the HHM service.
- The recipient or their legal representative contacts HHM and presents sufficient reason why the identity of the sender should be provided to them. This decision will be made at the sole discretion of HHM.
6 - WARRANTIES AND LIMITATION/EXCLUSION OF LIABILITY
6.2 - If the work carried out by HandwrittenHateMail.com is not what you have instructed or is defective in some material respect, HandwrittenHateMail.com shall have no liability to issue a refund. This includes the failure of the USPS to deliver the message. If you notify a problem to HandwrittenHateMail.com under this provision HandwrittenHateMail.com’s only obligation will be to re-perform the work. If a letter is undeliverable because you provided incorrect information, you will be responsible for a fee to cover the reproduction and re-mailing of the new letter.
6.3 - Notwithstanding Clause 6.2 HandwrittenHateMail.com shall have no liability whatsoever for the accuracy of transcriptions including, but not limited to, proof-reading of transcription or mistakes in transcription. HHM reserves the right to modify, change, exclude, or otherwise deviate from the requested message in order to achieve our creative vision. You acknowledge that your message will not be transcribed exactly as you enter it, and that it will be up to the interpretation and creative vision of the writers at HHM to craft the letter to your recipient.
6.4 - HandwrittenHateMail.com will not be liable to you for any loss, damage, costs or expenses of any nature whatsoever incurred or suffered of an indirect or consequential nature including, without limitation, any economic loss or other loss of turnover, profits, business or goodwill.
6.5 - Notwithstanding any other provision of these Terms and Conditions, in any circumstances where HandwrittenHateMail.com has not effectively excluded liability under or in connection with the services provided hereunder, HandwrittenHateMail.com’s maximum liability to you whether in contract, negligence, breach of statutory duty or otherwise shall not exceed the amount paid or payable by you for the work assignment in question.
7 - DISPUTE RESOLUTION: If any dispute or difference arises out of or in connection with these Terms and Conditions which we are unable to resolve by negotiation, then each of HandwrittenHateMail.com and you agree that the dispute shall be submitted to an independent mediator appointed by agreement between us to assist us in resolving the dispute; in the event that either of us should fail or refuse to agree to, or participate in, this dispute resolution procedure then either of us shall be free to seek to resolve matters pursuant to the provisions of the law applicable to the contract constituted by these Terms and Conditions with the Supreme Court of the State of New Jersey.
